By accessing PostalPromos.com or purchasing our services, you agree to be bound by the following Terms of Service ("Terms"). These terms govern your use of our website, our campaigns, and any services provided by PostalPromos (“we,” “us,” or “our”). Please read them carefully.

1. Overview of Services

PostalPromos provides direct mail marketing solutions to local businesses, including postcard design, printing, and distribution through both Targeted and Hybrid Campaigns. We also offer related print services such as flyers, brochures, business cards, and door hangers.

2. Eligibility & Availability

Our services are available to businesses located within the United States. We reserve the right to decline any project or order that does not align with our guidelines, ethics, or service standards.

3. Payment Terms

All campaigns and services must be paid in full prior to production, unless otherwise agreed in writing. Accepted payment methods include major credit/debit cards and approved third-party processors. Payment must be completed before list building, printing, or design begins.

4. Design, Proofing & Approval

Clients are responsible for reviewing and approving all design proofs prior to production.
Once a design is approved, PostalPromos is not liable for errors, misspellings, outdated offers, or incorrect contact information. By providing final approval, the client assumes full responsibility for the content included.

5. Targeting & Mailing

For Targeted Campaigns, mailing lists are created based on client-selected criteria such as income, home value, household size, and age.
For Hybrid Campaigns, we utilize USPS EDDM® routes but enhance targeting by manually selecting the most relevant zones.

PostalPromos does not guarantee results from any campaign. We use industry-standard data and strategies to maximize relevance, but response rates vary based on offer, season, industry, and other factors.

6. Delivery Disclaimer (Mailing)

PostalPromos uses USPS for campaign delivery. Once a campaign has been handed off to USPS, we are not responsible for postal delays, misdeliveries, or mail that is lost, returned, or undeliverable. Delivery estimates are not guarantees.

7. Refunds & Chargebacks

Due to the custom nature of our services, we do not offer refunds once a campaign has been approved and entered production.
Unauthorized chargebacks on approved services will be contested with proof of delivery, approval, and communication. By purchasing, you agree not to initiate a chargeback unless fraud or billing error occurs.

8. Content Ownership & Responsibility

You retain ownership of any logos, branding, or media you provide. However, you grant us a non-exclusive license to use your materials for the purposes of design and campaign production.

You are responsible for ensuring that all content provided is accurate, truthful, and legally compliant. We reserve the right to refuse content we deem offensive, misleading, or in violation of any laws or postal regulations.

9. Intellectual Property

All content, graphics, and materials created by PostalPromos — including postcard layouts, copywriting, and designs — remain our property unless otherwise transferred in writing. Unauthorized reproduction, distribution, or resale is prohibited.

10. Privacy & Data Use

All personal data collected is handled in accordance with our Privacy Policy, which includes details on how we collect, store, and use your information. We do not sell personal data.

11. California Privacy Rights

As a California-based business, we comply with the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA).
If you are a California resident, you have the right to request access, correction, or deletion of your personal data. See our Privacy Policy for details on how to exercise these rights.

12. Limitation of Liability

To the fullest extent permitted by law, PostalPromos is not liable for:

• Any indirect, incidental, or consequential damages

• Loss of revenue or business due to campaign results

• Errors approved by the client

• Postal issues or delivery failures outside our control

Our total liability will never exceed the amount paid for the service in question.

13. Service Modifications & Interruptions

We reserve the right to change or discontinue any service at any time without notice. We are not liable for interruptions caused by technical issues, maintenance, or third-party service failures.

14. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California, unless otherwise required by applicable law.

15. Updates to These Terms

We may update these Terms at any time. The most current version will always be posted on this page. Continued use of our services after updates implies acceptance of the revised Terms.
